§ 1. Acceptance of Terms

1. By registering for, accessing, or using make-a.click ("the Platform", "the Service", "We", "Us"), you agree to read, understand, and be legally bound by these Terms of Service. If you do not agree to these terms in their entirety, you are strictly prohibited from using the Service and must deactivate your account immediately.

§ 2. Description of Service

1. make-a.click provides users with tools to build, customize, host, and share personal bio link pages, including widgets (countdown timers, YouTube/Spotify embeds, social link integrations, etc.).

2. We reserve the right to modify, suspend, or discontinue any feature, tool, or part of the Service at any time without notice or liability to you.

§ 3. Account Registration & Security

1. To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration — including your real date of birth — and keep it updated. You are solely responsible for safeguarding your login credentials (username and password) and for any activity that occurs under your account. You must notify us immediately of any unauthorized use or security breach.

2. By registering, you confirm that you meet the minimum age requirement applicable in your country or region (see § 11 – Age Restrictions). Providing a false date of birth to circumvent age restrictions constitutes a material breach of these Terms and will result in immediate account termination.

§ 4. User Content & Conduct Guidelines

1. You retain ownership of any text, images, links, graphics, and widgets ("User Content") you publish on your profile. However, you grant us a worldwide, royalty-free license to host, display, and distribute your content for the sole purpose of operating the Service.

2. You agree not to upload, link to, or distribute any content that:

• Is illegal, defamatory, threatening, abusive, harassing, hateful, or discriminatory on the basis of race, religion, ethnicity, gender, sexual orientation, or disability.
• Contains phishing pages, scams, malicious code, malware, spyware, or deceptive redirects.
• Infringes on the intellectual property, copyright, patent, trademark, or privacy rights of any third party.
• Contains or links to pornography, explicit sexual content, nudity, adult entertainment websites, OnlyFans-style content, or any NSFW (Not Safe For Work) material of a sexual nature.
• Promotes, glorifies, or depicts sexual violence, child sexual abuse material (CSAM), or any exploitation of minors. Any such content will be immediately reported to the relevant authorities.
• Links to or promotes websites, services, or platforms intended for adults only (18+) without our explicit prior written approval.
• Promotes self-harm, suicide, eating disorders, or any content harmful to mental health, especially when directed at minors.
• Involves purchasing, selling, trading, or manipulating page statistics, including buying fake followers, artificial views, bot interactions, or coordinated traffic manipulation. All profile interactions must be organic.
• Promotes gambling, betting services, or unlicensed financial services without explicit authorization.

3. Violation of any of the above will result in immediate content removal, account suspension, and may be reported to law enforcement where applicable.

§ 5. NSFW & Adult Content — Zero Tolerance Policy

1. make-a.click is a general-audience platform accessible to users of all ages, including minors. Therefore, we enforce a strict zero-tolerance policy against any adult or sexually explicit content.

2. This includes, but is not limited to: pornographic images, videos, or written descriptions; links to adult websites (pornography sites, adult cam platforms, escort services, adult subscription platforms); suggestive or sexualized depictions of minors under any circumstances; solicitation of sexual services or content; erotic fiction, hentai, or other sexually explicit artwork; semi-nude or "softcore" content that is intended to be sexually suggestive.

3. Accounts found in violation of this policy will be permanently banned without warning. We cooperate fully with law enforcement in cases involving child sexual abuse material (CSAM).

§ 6. Verification and Abuse Prevention

1. Users may submit verification requests to obtain a verified badge on their profile. To process and approve these requests, we collect and store personal details, specifically your name and date of birth.

2. This data is retained and processed solely for the following purposes: Identity Verification to verify your real identity or eligibility to prevent impersonation of public figures, brands, or other users; Age Verification & Safety to ensure compliance with legal age requirements and protect minors using the Platform; Abuse Prevention to prevent duplicate requests, automated registrations, spamming, and overall platform abuse.

3. Verification is granted at our sole discretion. We reserve the right to revoke verification status or suspend accounts that submit fraudulent information or violate these Terms.

§ 7. Duševné vlastníctvo / Intellectual Property

1. All aspects of the Service, including the website design, logos, assets, custom components, icons, and software, are the exclusive property of make-a.click and are protected by copyright, trademark, and other laws. You may not copy, reverse engineer, or exploit any portion of our platform without prior written authorization.

§ 8. DMCA & Copyright Infringement (Asset Usage)

1. If you believe that content or assets on make-a.click infringe your copyright, or if you suspect any unauthorized usage of our official assets elsewhere, please send a written notice to legal@make-a.click containing details of the copyrighted work/assets, URL/location, your contact details, and statements of good faith and accuracy under penalty of perjury.

2. We will respond to valid DMCA and legal notices and take appropriate action, including content removal where required.

§ 9. Disclaimer of Warranties

1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the reliability, security, availability, uptime, or accuracy of the Service. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

§ 10. Limitation of Liability

1. To the maximum extent permitted by law, make-a.click and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses arising from your access to or use of the Service.

§ 11. Age Restrictions & Parental Consent

1. Access to make-a.click is subject to minimum age requirements based on your country of residence, in compliance with applicable laws including GDPR (Art. 8), COPPA (US), PIPL (China), and LGPD (Brazil):

2. Users below the applicable "full access" age must have verifiable parental or guardian consent to register. We collect and verify date of birth and IP-based country information at registration for this purpose. Providing a false date of birth to bypass these restrictions is a violation of these Terms and will result in permanent account termination.

3. Parents or guardians who believe their child has registered without consent may contact us at support@make-a.click to request account removal.

§ 12. Termination

1. We reserve the right to suspend, terminate, or delete your account and restrict your access to the Service at any time, with or without cause, and without prior notice, particularly for violations of these Terms of Service. Reasons for immediate termination include: Posting NSFW, pornographic, or sexually explicit content; Distributing or linking to CSAM (child sexual abuse material); Providing false age or identity information; Harassment or hate speech; Any illegal activity.

§ 13. Changes to Terms

1. We may update these Terms of Service from time to time. We will indicate the date of the latest update at the top of this page. Your continued use of the Platform after any revisions become effective constitutes your acceptance of the updated terms.

§ 14. Governing Law & Contact
